1. Acceptance of Terms

By downloading, installing, accessing, or using BrainQ (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and BrainQ ("we", "our", or "us") governing your use of the App.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App. Your continued use of the App after any changes constitutes acceptance of the modified Terms.

2. Eligibility

Age Requirements

• You must be at least 13 years of age to use the App.
• If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian.
• If you are under 13, please do not use this App.

3. Description of Service

BrainQ is a free-to-play math and logic puzzle game that includes:

• Progressive puzzle levels with increasing difficulty
• Daily challenges with streak tracking
• Achievement system
• Optional Google Play Games integration
• Optional cloud save functionality
• Local notifications for reminders (can be disabled)

The App is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any feature of the App at any time without prior notice.

4. User Accounts

Google Play Games Sign-In

• The App offers optional sign-in through Google Play Games.
• By signing in, you authorize us to access your Google Play Games profile (display name and player ID only).
• You are responsible for maintaining the security of your Google account.
• You must not share your account access with others.

Cloud Save

• If you sign in, your game progress may be synced to our cloud servers.
• Cloud sync is optional and can be disabled by signing out.
• We are not responsible for data loss due to network failures, device issues, or other circumstances beyond our control.

Account Deletion

• You may request deletion of your account and all associated data through the App's Settings.
• Account deletion requests include a 15-day grace period during which you can cancel the request.
• After the grace period, all data associated with your account will be permanently and irreversibly deleted.
• Immediate deletion without a grace period is also available if you prefer.

5. Advertising

The App is supported by advertising through Google AdMob.

Ad Types

• Banner Ads: Displayed at the top or bottom of certain non-gameplay screens.
• Interstitial Ads: Full-screen ads displayed at natural transition points between game levels. You can close these ads after a brief display period.
• Rewarded Video Ads: Optional video ads that you may choose to watch in exchange for in-game benefits (hints and puzzle solutions).

Your Choices

• Rewarded ads are entirely optional — you are never required to watch them.
• You can manage ad personalization preferences through the consent dialog or your device settings.
• We do not control the specific content of ads served by Google AdMob.

6. In-App Content & Intellectual Property

Ownership

All content in the App, including but not limited to puzzles, images, text, graphics, logos, icons, audio files, and software code, is owned by BrainQ or its licensors and is protected by copyright, trademark, and other intellectual property laws.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not permit you to:

• Modify, adapt, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or proprietary notices
• Use the App for any commercial purpose
• Redistribute, sublicense, or transfer the App

Puzzle Content

• All puzzles, solutions, hints, and related content are original works owned by BrainQ.
• You may share puzzle screenshots through the App's built-in share feature for personal, non-commercial purposes only.

User-Generated Content

The App does not include user-generated content features. You cannot upload, post, or share content within the App beyond using the built-in share feature.

7. Prohibited Conduct

You agree NOT to:

• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to the App, other users' data, or our servers.
• Use cheats, exploits, automation tools, bots, hacks, mods, or any unauthorized third-party software to modify or interfere with the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Artificially manipulate game progress, achievements, or statistics.
• Artificially generate ad impressions or clicks.
• Impersonate any person or entity.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App to collect information about other users.
• Use the App for any commercial purpose without our written consent.

8. Notifications

The App may send local notifications to your device, including:

• Daily challenge reminders
• Streak warnings
• Milestone celebrations
• Welcome messages (for new users)
• Inactivity reminders

9. Data & Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

We Do Not Warrant That

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The results obtained from use of the App will be accurate or reliable

This disclaimer applies to the fullest extent permitted by applicable law. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRAINQ, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your access to or use of (or inability to use) the App
• Any conduct or content of third parties on or through the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your data
• Loss of game progress or achievements
• Interruption or cessation of the App's functionality

Some jurisdictions do not allow the limitation of liability for certain damages, so some of these limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless BrainQ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App
• Your violation of any rights of a third party
• Your violation of any applicable laws or regulations

14. Termination

Termination by You

• You may stop using the App at any time by uninstalling it from your device.
• You may delete your account and data through Settings → Delete Account.

Termination by Us

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including:

• Violation of these Terms
• Artificial manipulation of ad interactions
• Use of cheats, exploits, or unauthorized tools
• Any other conduct we deem harmful to the App or other users

Effect of Termination

• Upon termination, your right to use the App ceases immediately.
• Provisions of these Terms that by their nature should survive termination shall survive, including Disclaimers, Limitation of Liability, and Indemnification.

15. Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Dispute Resolution

• Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at srinfodevelopers@gmail.com.
• If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority in India.
• You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.

16. Changes to the App

We reserve the right to:

• Modify, update, or discontinue any feature of the App at any time
• Change puzzle content, difficulty levels, or progression systems
• Modify achievement requirements or rewards
• Update ad formats, frequency, or placement
• Introduce new features or remove existing ones

We will endeavor to provide notice of significant changes through the App's update mechanism, but are not obligated to do so.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrainQ regarding your use of the App and supersede all prior agreements, understandings, or representations.

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
